3iconexxion research llc produces earlybirddiners.com, which provides reviews and information about restaurants, food, and other places. Reviews may be written by our staff or contributors. All content, reviews, and pictures are called "EBD Works".
The reviews are based on publicly available information and personal experiences at the time of posting. They are for entertainment only and don't guarantee that others will have similar experiences or opinions.
These Terms of Service control your access to and use of EBD Works.
1. CHANGES TO EBD WORKS

We don't promise that EBD Works will meet your needs, be uninterrupted, timely, secure, error-free, accurate, or reliable, or that the quality will meet your expectations. Views expressed through EBD Works don't reflect official positions of our affiliates.
9. LIMITATION OF LIABILITY. We're not liable for direct, indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, use, or data, even if advised of such possibility. This applies whether based on contract, tort, negligence, or strict liability.
This limitation covers: (i) use or inability to use EBD Works; (ii) cost of substitute services; (iii) unauthorized access to your data; (iv) third party conduct; or (v) any other matter related to EBD Works.Our total liability cannot exceed what you paid us in the last 6 months, or $100, whichever is greater.
If dissatisfied, your only remedy is to stop using EBD Works.
10. TERMINATION
We may suspend or terminate your account or use of EBD Works at any time for any reason, including inactivity or violation of these Terms. Suspected fraudulent or illegal activity may be reported to law enforcement. We may discontinue EBD Works at any time without notice.
Termination may happen without prior notice. We may immediately deactivate your account and delete all related information. We're not liable for terminating your access.
11. DISPUTE RESOLUTION BY BINDING ARBITRATION
a. Agreement to Arbitrate
All disputes between you and 3iconexxion research llc arising from these Terms, EBD Works, advertising, or our relationship will be resolved through final and binding arbitration, not court. By agreeing to these Terms, you waive your right to a jury trial or class action. The Federal Arbitration Act governs this agreement.
b. No Class Actions You and we can only bring claims individually, not as part of a class or representative action. The arbitrator cannot consolidate claims or preside over class proceedings. Relief is limited to individual claims, except for public injunctive relief where required by law.

c. Confidentiality All aspects of arbitration, including rulings and awards, are strictly confidential.
12. USER DISPUTES. You're solely responsible for interactions with other users. We have no liability for user disputes but reserve the right to become involved.
13. GENERAL. These Terms constitute the entire agreement between you and us, superseding prior agreements. Additional terms may apply when using affiliate services or third-party content.
Illinois law governs these Terms without regard to conflict of law provisions. For disputes not subject to arbitration, you submit to the exclusive jurisdiction of state and federal courts in the Chicago metropolitan area.
Our failure to enforce any provision doesn't waive that right. You cannot assign these Terms without our written consent; we may assign them without restriction. Section titles are for convenience only.
